Legal notice regarding cannabis use
Given the specificities of the Cannabis Sativa L plant and attentive to the current legal framework, it is important to ensure the protection of consumers’ interests, including good practices in the food trade, taking into account, always, an adequate protection of their health.
In recent years, there has been an increase in demand and availability in the national market of foodstuffs and herbal products which include the Cannabis sativa plant, its seeds, extracts, oils, or just its chemical substances. isolated as cannabidiol (CBD) or other cannabinoids.

The European Commission considers that foodstuffs with extracts from any part of the Cannabis sativa L plant, as well as foods to which Cannabis sativa L extracts have been added (eg seed oil, are new authorized foods, provided that the tetra content -hydrocannabiol – THC of the surfaces (stem and seeds) of the plant varieties used does not exceed 0.2% (w / w), as provided for in Regulation (EU) No. 1307/2013 of 17 December, however, the European Commission considers that the specific legislation of each Member State regarding restrictions on the placing on the market of cannabis as a food or as a food ingredient (COM, 2019) should be complied with.
In Portugal, Decree-Law no. 15/93, of 22 January, which defines the legal regime applicable to the trafficking and consumption of narcotic drugs and psychotropic substances, and Regulatory Decree No. 61/94, of 12 October, which establishes the rules relating to the control of the lawful narcotic drugs, psychotropic substances, precursors and other chemicals susceptible to use in the manufacture of drugs, included in Tables I to VI attached to Decree-Law No. 15/93, of 22 January. These diplomas prohibit the cultivation of hemp (Cannabis sativa L) without exception the cultivation of varieties that are destined for industrial purposes. However, the most recent legislation (Law No. 8/2019, 23rd amendment to Decree-Law No. 15/93 of 01/22, which approved the legal regime applicable to trafficking and consumption of narcotic drugs and psychotropic substances, and which transposed the Directive ( EU) 2017/2103, of the European Parliament and of the Council, of 15 November, provides for the use of the cannabis plant only for medicinal purposes, in medicines, preparations and substances, with medical prescription (INFARMED, 2019).
Thus, foods derived from the Cannabis sativa L plant authorized to be marketed in the European Union, and which have a history of safe and significant consumption, are those derived exclusively from hemp seeds, namely seed oil, hemp protein, hemp flour, and always with the premise that they come from varieties of Cannabis sativa L containing THC less than 0.2% (w / w) and provided that they do not present health claims and therapeutic properties on their labeling / advertising.
Thus, and in accordance with the requirements of Regulation (EU) No. 2015/2283, on Novel Foods and Food Ingredients, the flowers, leaves and extracts of any part of the Cannabis sativa L plant, as well as foods to which they have these parts and / or extracts have been added are new foods and in order to be placed on the market they will have to go through the authorization procedure, as established in Regulation (EU) No. 2015/2283, to which a risk analysis will be carried out by the Security Authority European Food Policy (EFSA).
Regarding the use of cannabinoids, namely cannabidiol (CBD) and delta-9-tetrahydrocannabinol (THC), cannabigerol (CBG), cannabinol (CBN) and others, used in food, like plant parts and their extracts, are considered new unauthorized foods (COM, 2019), with no history of significant and safe consumption in the European Union being demonstrated before 15 May 1997. Thus, the marketing of foods with these substances is not authorized.

Several studies of the effects of cannabis sativa L and cannabinoids on human health involve both therapeutic, adverse or toxic aspects. There is still no definitive scientific or medical consensus regarding the damages or benefits of its use.
Attention! Since November 2001, the acquisition, possession and consumption of drugs is no longer considered a crime in Portugal. Consumption was decriminalized, but not decriminalized. Consuming illicit psychoactive substances, remains an act punishable by law, however it ceased to be a target of criminal proceedings (and as such dealt with in the courts) and became a social offense.
This change in Portuguese legislation, commonly called the Law on the decriminalization of consumption (Law nº30 / 2000, of 29 November) changed the way we look at a drug user, leaving aside the prejudice that compared him to a criminal, passing to consider you as a person who needs help and expert support.
Possession of cannabis is punished as an offense, if it is intended for personal consumption, limited to 25g of flower, 2.5g of ham and 2.5g of Cannabis Oil. The limits are defined by 10 daily doses and if they are exceeded it is considered a crime, which may be drug use or drug trafficking.
